Rules on Publishing 18+ User-Generated Content and NSFW Policy

This document sets out the rules governing the publication of gaming and gaming-related content associated with computer and video game simulators and their communities on the Simo platform. These Rules form part of the Platform's Terms of Service and apply to all formats of published material, including attachments and User-Generated Content (UGC).

1. General Provisions

1.1. Simo (the-simo.com; hereinafter referred to as the "Platform", "Simo", "we" or "us") is a social platform for communities centred around various types of computer and video game simulators. Posts must relate to such games, gameplay, characters, user-created modifications, in-game stories, creative works and related community events.

1.2. These Rules apply to all materials that a User publishes, uploads or transmits through Simo, including images, screenshots, videos, GIFs, audio recordings, text, stories, comments, avatars, cover images, links, files and archives attached to posts, as well as objects and files published in the dedicated Custom Content section (hereinafter referred to as "CC") and, where the relevant functionality is available, messages.

1.3. Content created within a video game, using mods, an editor or AI, shall be assessed according to its substance. The fact that material originates from a video game does not, in itself, exempt it from compliance with these Rules or applicable law.

1.4. For the purposes of these Rules, NSFW means material intended for an adult audience that requires its preview to be concealed. An NSFW label does not make prohibited material lawful or replace mandatory age verification in countries or circumstances where such verification is required by law.

1.5. Simo may impose territorial restrictions on certain categories of posts or access to the service where required by the laws of the relevant country or where deemed necessary by the operator following a risk assessment. The fact that the Platform is internationally accessible does not mean that all material is permitted in every country.

2. Access to the Service: Adults Only (18+)

2.1. Simo is intended exclusively for Users aged 18 or over, regardless of their country of residence. Upon registration, each User must confirm that they are at least 18 years old. Additional age verification shall be carried out in countries and in respect of content or features for which such verification is mandatory under applicable law. Simo shall implement the verification measures required by such law before granting access to the relevant material or features. In all other cases, Users shall confirm that they are of legal age by providing their date of birth during registration, unless otherwise required by law.

2.2. Users must not provide false information about their age, circumvent age restrictions or mandatory verification procedures (where applicable), use another person's information or grant access to individuals under the age of 18. Simo may restrict access or request proof of age where there are reasonable grounds to doubt that a User is an adult or where required by law.

2.3. The restriction on access to Simo by persons under the age of 18 applies in all countries, regardless of whether mandatory age verification is required. This restriction does not affect the prohibition on sexualised content involving underage in-game characters: the requirements set out in Section 5 apply without exception.

2.4. In countries and circumstances where additional age verification is carried out, the relevant procedure and the processing of associated personal data shall be described in Simo's Privacy Policy. The Platform shall implement the safeguards required by law and endeavour not to collect more data than is necessary to verify that a User is an adult.

3. Categories of Published Content

Where a single post, attached archive or CC item contains materials belonging to different categories, the strictest applicable category shall apply to the entire relevant item. If an attachment contains prohibited material, Simo reserves the right to remove or block either the attachment or the entire publication.

4. Permitted Content and When an NSFW Label Is Required

4.1. Content Permitted Without a Mandatory NSFW Label

• Ordinary scenes from characters' lives, including building, family life, relationships, friendship, conflicts, arguments, romantic encounters, kissing and hugging, provided that they do not involve explicit sexualisation.
• Adult characters wearing ordinary clothing, swimwear or underwear, provided that there is no emphasis on intimate body parts and no sexual activity.
• Scenes in bars, restaurants and at parties; glasses of wine, beer, cocktails and bottles; moderate intoxication and ordinary consumption of alcohol by in-game characters.
• Smoking cigarettes, cigars and hookah, and using vapes by in-game characters, provided that there are no shocking consequences, instructions or advertising of products prohibited in the applicable jurisdiction.
• Ordinary in-game deaths, funerals, graves, ghosts, fights, threats and criminal storylines, provided that they do not contain graphic injuries or explicit bloody detail.
• Non-graphic references to illness, addiction, injury, suicide or violence in fictional storylines, provided that they do not describe methods of causing harm.

Users may voluntarily apply an NSFW label to otherwise general content if they consider it potentially sensitive for their audience. Such voluntary labelling shall not, in itself, constitute a violation of these Rules.

4.2. Content That Must Be Labelled NSFW

• Erotic scenes involving unequivocally adult fictional characters, including scenes created using game modifications (mods): sexualised embraces, poses and simulated intimacy, provided that they do not graphically depict sexual intercourse, genital contact or the physical mechanics of sexual activity. This permission applies only where none of the prohibitions in Section 5 are breached and subject to the laws of the country in which the content is displayed.
• Nudity involving adult characters, including depictions of genitals outside a sexual activity scene, as well as sensual poses and eroticised imagery that do not fall within the prohibition on pornographic material under Clause 5.4. The appearance of genitals in a graphic sexual activity scene does not become permissible merely by applying an NSFW label.
• Detailed sexual descriptions, erotic texts, dialogue and audio created for the purpose of sexually arousing an adult audience, subject to compliance with these Rules.
• Graphic in-game violence, including clearly visible bloody wounds, significant bleeding, dismemberment, detailed depictions of killings and corpses with visible injuries, provided that such content does not fall within any expressly prohibited category.
• Depictions of in-game characters using prohibited narcotic substances, injecting drugs, experiencing overdoses or severe poisoning, or suffering clearly dangerous consequences of substance use, provided that such content does not include instructions, offers to sell or encouragement to repeat such conduct.
• Realistic and graphic depictions of self-harm, suicide attempts and severe physical or psychological consequences, permitted solely as non-glorifying fictional content, without methods or instructions and without aestheticising harm.
• Particularly graphic descriptions of extreme violence and serious bodily injuries in text, even where the publication contains no images.

4.3. Rules for Applying the NSFW Label

4.3.1. The "Mark post as NSFW" label must be enabled by the author before publication. Following publication, the author must correct any incorrectly applied label where editing functionality is available.

4.3.2. The NSFW label applies to the entire post, including all images and carousel slides, videos, audio, text, descriptions, cover images and any attached files or archives, including their contents. If material requiring an NSFW label is located exclusively within an attached file, the entire post must still be labelled NSFW. Hiding only one slide, preview or cover image is insufficient if other NSFW material remains accessible.

4.3.3. Simo reserves the right to apply an NSFW label independently, restrict access by country, conceal a preview or remove a publication where these Rules have been breached.

4.3.4. An NSFW label does not replace a separate mandatory disclosure that AI was used, where such disclosure is required under Section 7.

4.3.5. For standalone publications in the "CC Content" section, the requirement to apply an NSFW label shall be determined by reference to the contents of the CC listing, preview images, description and all files and archives available for download, including the contents of such files and archives. An NSFW label applied to a related post does not replace the separate labelling requirement for the CC item itself.

Age restrictions and territorial restrictions apply not only to the CC listing and its preview, but also to the provision of files and archives for download, including where a User accesses a file hosted on Simo through a direct link.

If the required labelling and access restrictions cannot be implemented for NSFW content within a CC item, that item must not be published until the relevant functionality has been implemented.

5. Content Prohibited Even When Labelled NSFW

5.1. Sexualisation of Minors. Any sexual content involving real or fictional persons or characters under the age of 18, as well as characters presented or clearly depicted as minors, is prohibited.

This prohibition includes characters designated in games as children or teenagers, game models, animations, illustrations, texts, modifications and AI-generated images. Users must not circumvent this rule by formally changing a character's stated age where the character's appearance or the context clearly indicates that they are a minor.

5.1.1. Zero-Tolerance Policy and Response Procedures. Simo maintains a zero-tolerance policy towards the sexual exploitation of minors, including its depiction in in-game materials, animations and AI-generated content.

Upon detecting material suspected of violating this prohibition, Simo shall promptly restrict access to that material and conduct a review. If a violation is confirmed, Simo shall remove the material and take action against the relevant account, up to and including permanent suspension.

Where required by applicable law, Simo shall report detected material to the competent authorities and authorised organisations and retain the necessary information solely to the extent and in the manner permitted by law.

NSFW labels, "AI-generated" labels, the in-game or fictional origin of the material and its artistic context do not override this prohibition.

5.2. Sexual Violence and Exploitation. Graphic depictions of rape, forced sexual activity, sexual violence against humans or animals, sexual exploitation, or intimate acts involving characters who are unable to give consent (including characters who are unconscious or otherwise incapable of consenting) are prohibited.

This prohibition also applies to fictional in-game scenes. Non-eroticised discussion of these subjects in fictional text is permitted, provided that it contains no graphic details or glorification of violence.

Any sexual or erotic content involving animals, including in-game animals and animals created using mods or AI, is strictly and unconditionally prohibited.

The fictional, occult or non-human origin of a character does not, in itself, determine that character's age. General age restrictions and NSFW rules apply to humanoid characters, including vampires, ghosts, mermaids and aliens.

5.3. Incest and Other Forms of Exploitative Sexualisation. Sexual imagery and the eroticisation of close familial relationships, sexual slavery, human trafficking and other coercive sexual practices are prohibited, including where such material is created using mods.

5.4. Pornographic Content and Intimate Privacy. Simo prohibits pornographic photographs and videos of real people, as well as in-game, animated and AI-generated visual scenes that graphically depict sexual intercourse or its simulation.

For the purposes of these Rules, prohibited material includes, in particular:

• Depictions of genital contact with other genitals, other body parts or objects in a sexual context;
• Depictions of masturbation, oral, anal or vaginal sex;
• Depictions of penetration;
• Scenes that place primary emphasis on the physical mechanics and physiology of sexual activity.

This prohibition also applies to partially concealed anatomy where the nature of the activity is evident and graphically depicted.

Nudity involving an adult character outside a sexual activity scene is not prohibited in itself, but must be labelled NSFW in accordance with Clause 4.2.

These are Simo's internal content acceptability criteria and do not constitute a universal legal definition of pornography.

Intimate material involving a real person that is published without that person's consent, covert recordings, sexualised deepfakes, leaked intimate material and publications intended to blackmail or humiliate a person are strictly prohibited.

5.5. Dangerous and Illegal Content. Instructions or advice on manufacturing or unlawfully obtaining real drugs or weapons, causing serious bodily harm, committing crimes or suicide are prohibited. Offers to buy or sell illegal goods, as well as calls to commit violence, terrorism or other criminal acts, are also prohibited.

5.6. Real-World Cruelty and Encouragement of Harm. Real photographs or videos depicting torture, killings, serious violence or animal cruelty are prohibited, as are publications intended to glorify such acts.

Fictional in-game scenes depicting particularly sadistic torture for the purposes of sexual arousal or shock value are also prohibited.

5.7. Harassment and Threats. Threats, stalking, doxxing, impersonation, incitement to hatred or violence against individuals or groups on the basis of protected characteristics, and the publication of another person's personal data without a lawful basis are prohibited.

5.8. Deception, Malicious Material and Spam. Phishing, malware, fraud, the artificial distribution of prohibited content, mass spam, attempts to circumvent age verification, geographical restrictions or moderation decisions are prohibited.

5.9. Copyright and Other Rights Infringements. Pirated game builds, the unlawful distribution of paid mods and CC, publication of third-party materials without the necessary rights, and violations of the terms imposed by creators of user-generated modifications are prohibited. This includes restrictions on republication and the inclusion of files in compilations.

The conditions governing permitted use of third-party works and the requirements for compilations are set out in Clauses 8.5–8.11.

5.10. Advertising and Trading. Offers to sell drugs, illegal weapons, sexual services or other illegal goods or services are prohibited.

Commercial advertising of alcohol, tobacco, nicotine products and other restricted goods without separate authorisation from Simo is prohibited.

An ordinary in-game screenshot featuring a bottle or cigarette shall not, in itself, be considered advertising.

5.11. Content Outside the Scope of the Simulator Community. Simo is intended exclusively for gaming and gaming-related content associated with various types of computer and video game life simulators, creative activities and the communities surrounding such games.

Permitted content includes gameplay screenshots and videos, stories, reviews, mods and CC, fan art, guides, news, as well as personal photographs and videos directly related to the creation, streaming, discussion or promotion of gaming content within the relevant subject area.

Examples include a content creator attending TwitchCon, an industry meeting, a presentation or another community event.

When publishing material featuring real people, Users must respect their rights, applicable privacy requirements and the rules of the relevant event.

Publications, attachments and files in the CC section that fall outside this subject area are prohibited. This includes personal photographs and videos from holidays or everyday life that have no substantive connection to the relevant creative activities, unrelated games, general classified advertisements, political campaigning and the promotion of non-gaming goods or services.

A mere reference to a game or the use of a relevant hashtag does not, in itself, establish the necessary connection.

5.12. Other Unlawful Material. Any content that violates the applicable laws of the country in which it is published or lawfully displayed is prohibited, even if it is not expressly listed in this Section.

6. Examples of Classification of In-Game Publications

This table serves as a practical interpretation of these Rules. The content of the scene and the in-game age of the characters must first be assessed, followed by the degree of graphic detail. Where third-party modifications are used, the requirements of Section 8 also apply.
